CrowdSpot Terms of Service

These Terms of Service and Acceptable Use apply to organisations that run CrowdSpot projects and to participants who use public campaign maps. Privacy is covered by the CrowdSpot Privacy Policy and each project's Privacy Collection Statement.

1. Who these terms cover

• Organisations — clients and their admin users who create or manage a CrowdSpot campaign map.
• Participants — people who view a map or submit pins, comments, supports, photos, or survey answers.

By administering a project or submitting on a public map, you agree to these terms, including Acceptable Use below.

2. The service

CrowdSpot provides hosted map campaigns, submission flows, moderation tools, and related admin features. Today the product is delivered largely as a concierge service. We may change or suspend features with reasonable notice where practicable; security and abuse responses may be immediate. Organisations remain responsible for campaign copy, moderation decisions in their workspace, and use of exported data.

3. Accounts

Organisation admin access uses authenticated Organisations. Keep credentials secure and invite only authorised people. CrowdLab may retain super-admin access for support, incidents, and concierge setup.

4. Participant submissions

Submissions may appear on the public map under the project's moderation rules. By submitting, you grant the campaign organisation and CrowdSpot a non-exclusive licence to host, display, moderate, export, and use your contribution for the campaign and related reporting, as described in the project collection statement. Do not submit others' personal information without a lawful basis, or content you cannot share.

5. Content and moderation

Organisations moderate their project content in CrowdSpot. CrowdLab may remove or restrict content that breaches Acceptable Use or creates legal, security, or platform risk. We do not guarantee that contributions are accurate or endorsed by CrowdSpot or the organisation.

6. Acceptable Use

You must not use CrowdSpot to:

• Break applicable law, or encourage others to do so.
• Harass, threaten, defame, or target people with abuse or hate.
• Upload malware, bypass security, scrape abusively, or interfere with the service.
• Evade rate limits, fake engagement, or automate submissions without written permission.
• Run campaigns that are primarily spam, fraud, or deceptive.
• Collect sensitive information without a clear lawful purpose and appropriate notices.
• Infringe intellectual property or privacy rights.
• Misrepresent affiliation with CrowdSpot, CrowdLab, or another organisation.
• Run campaigns CrowdLab reasonably judges to create serious harm inconsistent with civic engagement use (we will explain a decision where we can).

We may suspend projects, accounts, or submissions that breach these rules.

7. Data and export

Organisations may export data available in admin tools. Retention and access requests follow the Privacy Policy and project collection statement. Formal self-serve retention schedules will be published when that product ships.

8. Intellectual property

The CrowdSpot platform remains CrowdLab / CrowdSpot property. Organisation logos and campaign materials remain the organisation's; you grant us a licence to host and display them for the project. Participant contributions are licensed as in section 4.

9. Availability

We aim for reliable hosting but do not promise uninterrupted availability in this concierge draft. Production incidents are handled by CrowdLab; day-to-day moderation stays with the organisation unless otherwise agreed.

10. Liability (draft)

To the extent permitted by Australian Consumer Law and other non-excludable rights, the service is provided on an “as is” basis for this draft period, and CrowdSpot is not liable for organisation decisions made using map data or for participant content. Nothing excludes liability that cannot be excluded by law. Counsel should replace this section before self-serve billing.

11. Changes and contact

We may update these terms by posting a new version at this URL with a new effective date. Contact: the form on crowdspot.com.au/contact or details in the Privacy Policy.

12. Governing law

These terms are governed by the laws of Victoria, Australia. Courts of Victoria have non-exclusive jurisdiction, subject to any non-excludable rights you have elsewhere.
